Sample Contract

Upon completion and acceptance of your puppy application a personalized contract will be emailed to you for review and submittal.

1. KanDew Yorkshire Terriers ("Seller") agrees to sell the above listed Yorkshire Terrier companion pet puppy to the ("Buyer") listed below.

2. The Buyer agrees that for the sum of $4000.00 this Yorkshire Terrier is being sold with American Kennel Club (AKC) Limited Registration and is designated for sole ownership.

​

3. A holding fee of 50% of the agreed purchase price is due immediately to hold the Yorkshire Terrier puppy exclusively for the buyer until the possession date.

4. Upon the date of possession, the Yorkshire Terrier puppy shall have had Parvo and Distemper vaccinations, preventative de-wormings as needed, and will have been treated with heartworm preventative. The Seller will provide for the Buyer veterinary records of the vaccinations and de-wormings that have been administered. The puppy will be microchipped with a paid lifetime registration with AKC Reunite. All records of such shall be provided at possession. The puppy will have a genetic health panel through Embark and copies of the results will be made available to the Buyer.

5. The Seller guarantees the above named Yorkshire Terrier to be free from life threatening genetic defects (such as liver shunt) for the first year of the Yorkshire Terriers life. Upon written documentation of the existing defect from a veterinarian selected by the Buyer, and confirmed by a veterinarian selected by the Seller, the Seller will give the Buyer a credit equal to the purchase price paid by the Buyer that the Buyer may use solely toward the purchase price of a replacement Yorkshire Terrier puppy from the Seller. The Buyer agrees that this shall be the sole remedy, and no action, civil or criminal, may be brought against the Seller in any jurisdiction. The Buyer agrees that the Seller shall not be responsible for any medical bills, supplies or other expenses of the Yorkshire terrier incurred under any circumstances. The Seller covenants that the Yorkshire Terrier puppy's parents, listed above, are clear of Patella and Trachea defects, but not as to the Yorkshire Terrier puppy itself, which can develop these conditions under normal circumstances or under extraordinary circumstances, any time after the date of possession.

6. The Seller assumes no liability for any injury to the Yorkshire Terrier at and after the time of possession, which is defined as placing the puppy in the custody of the Buyer. The Seller does not use third party ground or flight nanny delivery services and only transfers custody directly to the Buyer. The buyer has the option of (1) picking up the puppy directly from the Seller and doing a "meet and greet", (2) picking the puppy up at the Sellers local airport to be transferred to the custody of the Buyer and flown home by the Buyer, or (3) having the puppy flown with the Seller to the Buyer's local airport to be picked up by the Buyer for custody transfer. This contract does not include delivery costs. Any delivery cost will be negotiated and paid separately from this contract.

7. The Buyer agrees the Yorkshire Terrier is being sold on Limited AKC Registration (not for breeding). AKC papers will be supplied. The registration will be completed by, and registration fees will be paid by the Seller.

8. The Buyer agrees to keep the puppy in a clean, health and safe environment. The buyer agrees to provide a loving and nurturing home. The Buyer will adhere to good good dietary practices for the life of this Yorkshire Terrier. Buyer agrees that the Yorkshire Terrier will not be chained or tied or left outdoors unattended. The buyer agrees that the Yorkshire Terrier will not be allowed to run loose without the benifit of either a leash or containment. The buy agrees that the Yorkshire Terrier will not be allowed unsupervised free access to the outdoors through the use of "doggie" doors. The buyer agrees that the Yorkshire Terrier will not be contained by the use of invisible fencing or other electrical containment systems. The Buyer also agrees to provide proper veterinary care, including but not limited to the required vaccinations and the purchase and use of heartworm preventative for the lifetime of this Yorkshire Terrier. The seller takes no responsibility for monitoring the Buyer's care of this Yorkshire Terrier, but reserves the right to report any actual or suspected abuse to the relevant authorities.

9. The Seller neither makes nor implies any warranties or guarantees, expressed or implied, other then those written in this agreement. This agreement constitutes the entire agreement between the Seller and the Buyer, and any representations or statements made outside of this agreement have been superseded by this agreement.

10. In the event that any matter can not be amicably settled between the Buyer and the Seller, all legal disputes shall be brought in Haslet County, the county of the Seller's facility, or the county where the Seller's attorneys are located, at the option of the Seller, and in accordance with the laws of the State of Texas.

​

11. The Buyer agrees not to attack or criticize the Seller, it's owners, agents, employees, associates or partners publicly (on public forums, blogs, social networks, etc.). There shall be no ("defamation") at any time or for any reason after this agreement has been finalized, which shall be the date that this agreement is signed and dated by the Buyer and the Seller, not the delivery date. In the event that the Buyer violates this covenant, the Buyer agrees to pay $500.00 for each incident of defamation as damages, and for any legal fees, public relations costs, or court fees related to discrediting the defamation and collecting damages from the Buyer.

12. We care deeply about our Yorkshire Terriers and their happiness and well-being, and our goal is to be connected with the Buyer on the health and livelihood of their Yorkshire Terrier.

​

13. The Seller retains the right to cancel the sale at any time if the health or well-being of the Yorkshire Terrier is in question for any reason, or if the puppy does not pass a final veterinary examination, upon which time the holding fee will be immediately refunded. The Buyer agrees that the holding fee is nonrefundable for reasons related to Buyer's remorse or circumstance change and will be held completely or partially upon the discretion of the Seller.

14. In the case of a loss of communication from the Buyer with unresponsiveness to communication regarding the scheduled or proposed possession date, the puppy will be considered abandoned and all rights to the puppy and the nonrefundable holding fee are forfeit and the puppy will be placed in a different home.

​

15. The balance due ($2000.00) to take custody of the Yorkshire Terrier is due on or before the possession date. Cash may be paid in person at the time of pick-up or electronic payment may be sent in advance. Electronic transfers must be received in time to clear all bank holds before the puppy's custody will be transferred (usually 3-5 business days).
